Defamation

Not many lawyers take defamation cases. I handle a lot of them, for people and for businesses. When false statements are hurting your name or your company, I help you decide what to do about them, from a flat-fee cease and desist letter to a lawsuit.

Fact or opinion?

It's usually the first question I ask. Four made-up statements; tap one to see how it reads.

Made-up examples in general terms, not legal advice. Every case turns on its own words and facts.

What defamation is, in general terms

A false statement of fact, shared with other people, that damages someone's reputation.

Libel

Written statements, including online posts and reviews, are often called libel.

Slander

Spoken ones are often called slander.

Not usually

Opinions, insults and true statements usually aren't defamation, even when they hurt. Whether a statement crosses the line depends on its exact words and the facts around it.

That's why I start by looking at what was said, where, and by whom, and then tell you honestly whether it's worth pursuing.

When it's your name

False statements about you can follow you online, at work and in your community.

When it's your company

A false statement about your company or its owners can cost you customers.

A letter is often enough. When it isn't, I litigate.

  1. Cease and desist letters

A formal letter telling the person or company to stop and take the statement down, and putting them on notice.

    Flat fee

  2. Answering a cease and desist

If you received one, I help you understand the claim against you and decide how to answer.

    Fee confirmed at your consultation

  3. Defamation lawsuits

When a letter isn't enough, I litigate defamation claims in state and federal court.

Defamation is personal, even for a business.

When you hire me for it, you work with me directly. The first step is a 30-minute consultation for $100, by video or in person by appointment. Bring what's in the folder.
